Overview

• Effective Dec. 12, 2022, U.S. Citizenship and Immigration Services (USCIS) will automatically extend the validity of Green Cards for lawful permanent residents (LPRs) who have applied for naturalization.
• Due to lengthy processing times, LPRs who have filed N-400 to apply for citizenship, do not have to file Form I-90.
• For I-9 verifications, the expired Green Card, along with the N-400 receipt notice, is sufficient if presented before the expiration of the 24-month extension period provided in the notice.

Recently, the USCIS has experienced increased processing times, forcing applicants for citizenship (filed Form N-400) to also have to file Form I-90 as well to extend their Green Cards and maintain proper, lawful status while the USCIS processes the N-400. If Form N-400 is filed on or after December 12, 2022, the USCIS will automatically extend the Green Card expiration. If an I-9 needs to be re-verified, the receipt notice can be presented with the expired Green Card as evidence of continued status as well as identity and employment authorization under List A of Employment Eligibility Verification (Form I-9) if presented before the expiration of the 24-month extension period provided in the notice.
