The California Supreme Court has declared that “the employment relationship is fundamentally contractual.” Despite this legal reality, the contractual aspect of the employment relationship is often overlooked and misunderstood. In addition, recent legal developments have limited employers’ contractual rights and the enforceability of previously common contractual provisions. From arbitration agreements to confidentiality clauses, HR professionals are tasked with implementing and managing the agreements that govern the employment relationship. With the changing myriad laws that apply to these contracts, ensuring that companies have enforceable agreements that they can rely upon has become no small challenge. 

Walter will explore the contractual nature of the employment relationship, recent developments that raise risks for certain types of agreements, and the best practices to manage the contractual relationship between employees and employers.
