Deborah Winokur will speak on the panel “Witness Ethics: Avoiding the Minefields” for the American Bar Association Litigation Section. The panelists will cover various ethically challenging scenarios litigators routinely face and how to meet those challenges. The panelists will discuss the following:

  • When it is ethically permissible to confer with a witness during a deposition or while the witness is giving testimony
  • What the limits are under the ethics rules for posting excerpts from an opponent's deposition on a law firm's website
  • What lawyers must do under Model Rules 1.1 and 1.6 to address the inadvertent production of a privileged document
  • When it is ethically permissible to pay a fact witness
  • What the limits are under the ethics rules for friending a witness on Facebook to gather information to prepare for a deposition of that witness
  • What the ethical concerns are in taking a remote deposition where the lawyers and a witness, and a court reporter are appearing remotely
